Subtitles DO work in the later nightly builds. Select the Subtitles tab, click Add, Choose Foreign Audio Scan for Source and checkmark Forced Only and Burned In (or choose Default if you don't want just the forced subs)

I just did a second test and remuxing the file with mkvtoolnix does seem to resolve my issue. What's strang is not all of my conversions have that issue (though most do). So that leads to problem, there is no way to save the Preset. Even if I created a new one and went to save the changes, normally you would right-click and select Save-Changes. Peronsally I noticed increased encode times with the newer nightly builds. Maybe give that a shot and see if it improves any.
