I've run into the same problem several times now. I have a 2.33 MBP, and newer DVDs have been giving me this problem. However, not all of them. For what you want to do, just use the iPod-Hires or the iPod Touch preset. It will create a file that will be compatible with your iPod Touch and you won't have to worry about the other settings.
