got a solution to the problem another way.
handbrake has trouble with encoding or won't encode at least a AVCHD file that is made up of sections of that have been selected from a larger file and then stuck together into one smaller file.

AVCHD to mp4 problem
Have just started with Handbrake and successfully encoded several AVCHD files to mp4 files with no problems. However for a couple of others of these AVCHD files I am not getting any video. That is, the AVCHD file is being encoded into an mp4 file that has no video with it - just the audio. I can see...
