Try pointing HandBrakeCLI directly at the actual recording file (.mpg, .mp4, etc.) that lives inside the .eyetv package. If that doesn't work, export the recording from EyeTV as 'MPEG Program Stream' (this should just dump out the raw recording immediately rather than take time doing any transcoding...

Thanks for the suggestion. mkvmerge does indeed do exactly what I want but, as its name implies, appears only to output to mkv when the stated objective is to retain the mp4 container for Apple TV. In addition to adding the 'weightp=0' and vbv x264 settings discussed above, should CLI users on OS X also now be changing their -E options from faac to ca_aac for best ATV results, given what's just been confirmed in this thread?

I had this problem too. For me it was something really simple. Basically my ATV was trying to sync before I could do a command I and put the cover art, name, date, etc that I wanted to put in. So make sure your ATV doesn't sync until you have done everything in itunes that you were planning to do. ...

Your AppleScript looks okay to me, and the fact that your first file processes correctly makes me wonder if the delay in copying across the network is causing a folder action or AppleScript timeout on the subsequent files. To check, try repackaging your script as a droplet, and drag'n'drop your file...
